Continuing Education Time launches: Stricter rules and capped costs replace educational leave

Compared to the old regulation, the criteria for receiving the allowance have been significantly tightened. Applicants must "zwölf Monate durchgehend voll entlohnt beim aktuellen Arbeitgeber in Österreich voll versicherungspflichtig beschäftigt sein" to receive the allowance. Those who already hold a completed master's or diploma degree must additionally have worked in a mandatory insurance-covered job for at least four years. "Eine Wartefrist von 26 Wochen, also mindestens ein halbes Jahr, muss nun eingehalten werden, bevor eine Weiterbildungszeit angetreten werden kann", the AMS states. Furthermore, "ein direkter Anschluss der Weiterbildungsmaßnahme an die Elternkarenz nicht mehr möglich".

Only "nur noch Aus- und Weiterbildungen, die arbeitsmarktrelevant und überbetrieblich verwertbar sind" are funded. The continuing education time itself must comprise at least 20 hours per week, or 20 ECTS per semester in the case of a degree program, and at least 16 hours per week in the case of caregiving obligations.

Amount of the allowance and employer contribution

The financial support is graduated according to an income-based tiered model. "2026 beträgt die Mindest-Weiterbildungsbeihilfe 1286 Euro pro Monat (31 Beihilfen-Tagsätze)", the AMS announced. "Die Höhe der Beihilfe richtet sich nach einem einkommensabhängigen Stufenmodell und beträgt mindestens 41,49 Euro pro Tag (Wert 2026)." Including the employer contribution, up to 2,163 euros per month is possible.

The financial participation of companies is new. "Im Gegensatz zur alten Regelung müssen Unternehmen künftig einen finanziellen Beitrag leisten", the Ministry of Labour explained. "Wenn das Bruttogehalt über der halben ASVG-Höchstbeitragsgrundlage (derzeit 3.465 Euro pro Monat) liegt, hat sich der Arbeitgeber mit 15 Prozent an der Weiterbildungsbeihilfe zu beteiligen." For low-income earners, the new model is therefore financially more attractive than the old one.

Capped budget and pressure for reform

State costs are capped: "Aktuell sind die Ausgaben mit 150 Millionen Euro pro Jahr gedeckelt. Ist diese Grenze erreicht, werden keine weiteren Anträge mehr bewilligt." By comparison: "In der Hochphase der Bildungskarenz kostete die Maßnahme den Staat über 500 Millionen Euro jährlich." In the past, "unter anderem der Rechnungshof und das Wirtschaftsforschungsinstitut Wifo für eine Reform der Bildungskarenz" had called for reform in order to increase effectiveness.

Agreement with the employer

Those seeking continuing education time also require a written agreement with their employer. "In der Vereinbarung müssen zudem der aktuelle Bildungsstand, die Bildungsmaßnahme und ein Bildungsziel angegeben werden." According to the AMS, there is no legal entitlement to the funding.

Notes from the labour law expert

Labour law expert Karin Buzanich-Sommeregger, a partner at the business law firm Freshfields, pointed out the deadlines as a key new feature in conversation with DER STANDARD. "Den größten Unterschied zur alten Regelung ortet die Arbeitsrechtsexpertin bei den Fristen, die nun eingehalten werden müssen." She advises employees to "gleich zu Beginn schriftlich festzuhalten, dass die Freistellung nur stattfindet, wenn die Weiterbildung auch tatsächlich gefördert wird".

"Die Weiterbildungszeit kann etwa nicht mehr im Anschluss an eine Elternkarenz gemacht werden", warns Buzanich-Sommeregger. Applicants should therefore carefully review the timing. The 26-week waiting period and the requirement to be with one's current employer make forward-looking planning necessary.

The AMS is accepting applications from now on. Given the capped budget of 150 million euros and the stricter criteria, it is to be expected that not all submitted applications will be approved. No figures on the specific number of applications in the first days were available by editorial deadline.

Another background to the reform is the criticism that the old educational leave was not sufficiently tailored to the labour market. By focusing on labour-market-relevant and cross-company-usable training, as well as the stronger involvement of employers, the measure is to become more effective.
