Around 90 of 193 Austrian corporate groups must repay a total of approximately 37 million euros in COVID aid following a review by the Ministry of Finance, according to a ministry report.
The Republic of Austria can reclaim up to 106 million euros in paid-out COVID aid on the basis of a precedent ruling by the Supreme Court of Justice (OGH). The OGH ruled on 28 April 2025 that for state aid, the EU ceilings apply per conglomerate and not per subsidiary. On these grounds, the supreme court rejected national regulations and determined: „Das Höchstgericht hatte am 28. April entschieden, dass für staatliche Beihilfen die Limits pro Konzern und nicht pro Tochtergesellschaft gelten." The ruling is based on the principle that EU law supersedes national law.
