Austria will implement a ban on headscarves for girls under 14 in schools starting from the 2026/2027 academic year, sparking legal challenges and concerns among educators.

Strict Enforcement and Penalties

The ban applies to any head covering that conceals the hair according to Islamic traditions, regardless of the reason for wearing it. Schools have no discretion in enforcing the rule, as the procedure is strictly outlined in a government circular. Teachers must first reprimand a student for wearing a headscarf and ask her to remove it. If the student refuses, the school administration must inform both the student and her parents about the ban and its potential consequences.

Repeated violations could lead to fines ranging from 150 to 800 euros, and further non-compliance may trigger administrative penalty proceedings. Teachers, administrators, or government employees who fail to report or process violations may also face criminal consequences. The Ministry of Education has cited previous convictions for abuse of office in similar cases as a warning.

Paul Kimberger, head of Austria’s teachers' union, expressed concerns about the upcoming enforcement. "An den Schulen gibt es schon jetzt große Sorgen vor dem Herbst, wenn die Regelung 'scharf gestellt' wird," he said, highlighting worries about how the ban will be implemented in the fall. Kimberger also questioned whether authorities will support educators in enforcing the rule or leave them to handle conflicts alone: "Eine Hauptfrage ist auch: Werden die Behörden hinter uns stehen oder werden wir wieder alleingelassen bei diesen Dingen?"
