Bundesrat passes initiative for trade ban on possessions of Nazi victims

The motion states that "Andenken der im Nationalsozialismus verfolgten Menschen würden regelmäßig rein kommerziellen Interessen untergeordnet." The draft further states that the commercial exploitation of such items violates the dignity of those affected: "Dies verletze die Würde der Opfer."

The draft was introduced into the Bundesrat by the state of North Rhine-Westphalia. The core of the plan is the subordination of commercial interests to the commemoration of the victims of National Socialism. Museums, libraries, and archives that are committed to the remembrance of Nazi victims are to be exempt from the trade ban.

Which items are affected

Among the items to fall under the planned ban are documents, letters, and diaries of prisoners from concentration camps, as well as Star of David badges and other personal possessions. The aim is to prevent such testimonies from being treated as mere trade goods.

The chamber of the states approved the initiative on Friday in Berlin. The initiative now moves into the parliamentary procedure of the Bundestag. Since no deliberation deadlines are provided, it remains unclear when members of parliament will deal with the draft in a final reading.

Supporters of the ban point out that the sale of personal items of the persecuted through auction houses and online platforms has repeatedly caused outrage in recent years.
