The Administrative Court of Hanover has rejected an urgent application by the AfD state chapter of Lower Saxony against its classification as an object of observation of considerable importance by the Lower Saxony intelligence service.

With the decision on Monday, the authority may temporarily monitor the state chapter using intelligence methods, including surveillance, telephone tapping, and the use of informants. The court deemed the legal prerequisites for such observation to be met.

The intelligence service had upgraded the AfD Lower Saxony from a suspected case to an object of observation of considerable importance in mid-February. Previously, the state chapter had been classified as a suspected case since 2022. According to the authority, this phase could not be extended further, meaning that either the observation had to be terminated or placed on a new legal basis.
