The European Commission announced on 28 May 2026 a 200 million euro fine against the online marketplace Temu for failing to adequately assess and address the systemic risks posed by illegal products on its platform, marking the highest penalty ever imposed on a marketplace operator under the Digital Services Act.
The fine stems from a violation of the Digital Services Act (DSA), which requires very large online platforms to conduct thorough risk assessments. The Commission determined that Temu's 2024 risk assessment was insufficient, lacking specificity and not reflecting the actual extent of potential consumer harm.
Deficient Risk Assessment
EU Commission Vice President Henna Virkkunen stated: 'Risikobewertungen sind keine Box-Ticking-Übungen – sie sind das Rückgrat des Gesetzes über digitale Dienste.' She added: 'Die Risikobewertung von Temu unterschätzt konkrete Risiken, es fehlt ihr an Spezifität, sie stützt sich nicht auf solide Beweise und ist nicht umfassend.'
The Commission's findings were based on its own investigations, studies by consumer protection organizations, and test purchases. These revealed that a very high proportion of small electronics and chargers sold on Temu failed basic safety tests.
