The judge's rebuke

The case against Rhodes had produced a conviction on seditious conspiracy and related charges, making him one of the highest-ranking defendants sentenced in connection with the riot. Earlier proceedings had resulted in prison terms for Oath Keepers members and other defendants found by juries to have planned and participated in the breach of the Capitol building on January 6, 2021.

The Justice Department's request to dismiss reflected a shift in priorities after the change in administration. Legal analysts said the ruling was notable less for its outcome, which the government itself had sought, than for the unusually direct language the judge used to distance himself from the department's position. By writing that the move "excuses criminal acts," Mehta placed on the public record his disagreement with the executive branch's assessment of the case.

The Justice Department declined to comment on the judge's specific criticisms, referring reporters to its earlier filings in the case. A spokesperson repeated the department's position that the decision to dismiss was made after a review of the evidence and the department's enforcement priorities.

The dismissal does not vacate the earlier convictions of other Oath Keepers members or of co-defendants prosecuted alongside Rhodes. Those sentences remain on the books, and the court records associated with them are unaffected by Tuesday's order, which addressed only the remaining count tied to Rhodes.

Mehta closed the order by reiterating his view that the convictions secured at trial reflected the seriousness of what he called "a direct assault on the functioning of the federal government." He wrote that the work of prosecutors, agents and officers who brought the cases to verdict should not be undermined by the later decision to abandon the final prosecution.

The episode leaves intact a substantial body of case law and factual findings from the January 6 trials, while formally ending the last active criminal matter arising from the Capitol breach. It also adds a sharply worded judicial statement to the ongoing debate over how the events of that day should be characterized and prosecuted.
