Four Vienna police officers went on trial at the Wiener Landesgericht on charges of neglecting a Ukrainian man who suffered a stroke while in their custody following his arrest at the Schwarzenbergplatz in May 2024.

Background of the arrest

The case centers on a 54-year-old Ukrainian worker, referred to in court as Herr K., who was taken into custody on 9 May 2024 after a confrontation with officers near the Soviet war memorial at the Schwarzenbergplatz. According to the indictment, Herr K., who has lived in Austria since 2012, was brought to the ground in an improper manner by the lead officer, who is alleged to have grabbed him around the shoulder and neck area and used a pulling and twisting motion that resulted in a neck-and-throat trauma later linked to his stroke. The man had a blood alcohol level of 0.76 per mille at the time of his arrest.

Prosecutors allege that over the following hours, while Herr K. was held at the Polizeianhaltezentrum (PAZ) Rossauer Lände, the officers failed to recognize that he was in medical distress. The detainee was kept for roughly six hours and released shortly before 21:30 with a small fine. He has since joined the criminal proceedings as a private claimant and is seeking 80,000 euros in damages — 30,000 euros for pain and suffering and 50,000 euros for lost earnings over the past two years. He is now 56 years old.
