Fraudster from Vienna Must Serve Nearly Three Years Behind Bars

Before Judge Alfred Hebenstreit-Weinauer and two lay judges, the accused largely confessed to the acts. When a warrant was liquidated, he panicked, he explained according to the trial report. He had originally wanted to invest the money, but then everything turned out differently. This account did not prevent the court from classifying the fraud as intentional conduct and imposing a severe sentence.

The lay judges' panel found it proven that the man fulfilled the offense of aggravated fraud in 32 cases. In addition, the embezzlement of three private loans entrusted to him was established. According to the indictment, the total damage amounted to approximately 400,000 euros. According to the court, the victims are mostly friends, acquaintances, and family members of the defendant.

How the Fraud Unfolded

During the proceedings, several victims testified and described how much they had trusted the accused and, in some cases, had even contributed smaller sums. One witness reported that she had been waiting for a supposed payout and only learned of the loss of her money after making inquiries. In his closing statement, the accused apologized to his victims, asked for clemency, and referred to his addiction problems.

In addition to the unconditional prison sentence, the court also awarded partial restitution. Should the sum not be paid within a set deadline, an additional substitute custodial sentence of 200 days is threatened. This is intended to ensure that the victims are at least partially compensated, according to the reasoning.

With the verdict, the lay judges' panel essentially followed the prosecution's request, which had called for a multi-year prison sentence. The defense announced that it would review the possibility of an appeal on points of law and an appeal on the merits. Until the case becomes final, the accused will remain in pretrial detention, according to court circles.

Damage Amount and Verdict

The proceedings at the Vienna Regional Court for Criminal Matters were particularly sensitive due to the personal relationship between perpetrator and victims. Several victims described that they had given the money based on family or friendly ties. The court considered the scale of the damage and the duration of the crime – around two years – as aggravating factors, while a confession and the partial willingness to make restitution were taken into account as mitigating factors.

In the coming weeks, additional civil suits by individual victims could still be filed. Observers expect that the verdict will also cause waves in Vienna's financial scene, since many of the victims came from the man's private circle and lost large sums based on supposedly private investments.

The hearings before the lay judges' panel chaired by Hebenstreit-Weinauer had recently taken several court days. With the verdict announced on Wednesday, the first major phase of the criminal proceedings has come to an end. The prosecution expressed satisfaction with the outcome; the defense, as mentioned, announced further steps.

Possible Consequences for the Victims

Chronologically, the case fits into a growing number of proceedings in which private individuals are specifically asked for money within their circle of acquaintances. The Vienna Public Prosecutor's Office has recently warned repeatedly about such schemes, in which alleged investment products or sports betting serve as bait. The man now convicted was registered neither as a financial advisor nor as a sports betting broker.

For the victims, the verdict at least offers a certain measure of satisfaction, although the prospect of full repayment is considered slim. Some of the victims stated during the proceedings that they felt personally deceived and that their trust in the accused had been deeply violated.
