Hellweg Austria files for restructuring proceedings – six stores remain open

Six locations in three federal states

The Austrian locations are spread across three federal states. In Upper Austria, Hellweg operates branches in Ried im Innkreis and Kirchdorf an der Krems; further stores are located in Salzburg and Styria. In total, there are six hardware and garden centers that will now be placed under the protection of the restructuring proceedings.

The Hellweg Group cited several factors to justify the step. These included a „zurückhaltende Konsumnachfrage", „Belastungen entlang der Lieferketten", and „steigende Miet- und Betriebskosten". These factors have so exacerbated the company's economic situation that an orderly restructuring proceeding has become necessary.

Consequences for employees and customers

The filing in Austria follows the insolvency of the German parent company in mid-June. The Austrian subsidiary is directly affected by the consequences of this development, which is why independent proceedings have now been opened to continue business operations in Austria. The temporal connection with the German insolvency shows that the crisis at the parent company is directly impacting the company.

For customers, little should change in the short term according to the company. „Die sechs österreichischen Märkte in Oberösterreich, Salzburg und der Steiermark bleiben mit dem vollen Sortiment laut Firmenangaben geöffnet", Hellweg stated. Also, „Kundenkarten, Rabatte und laufende Aktionen behalten ihre Gültigkeit".

Hellweg Austria announced that employees would be informed about the situation on Monday. An initial staff meeting is planned to discuss the next steps in the restructuring proceedings. Management emphasized that the goal of the proceedings is explicitly the continuation of the company and that no site closures are planned.

Self-administration as a restructuring model

In restructuring proceedings with self-administration, management remains in office but is supervised by a restructuring administrator appointed by the court. This model allows the company to draw up its own restructuring plan and implement it under court supervision. Self-administration is generally seen as a sign that the company still sees a realistic chance of a successful restructuring.

The restructuring experts who are to oversee the proceedings have, according to the company, already experience with similar restructuring processes in retail. They are to help develop the restructuring plan and conduct negotiations with creditors, suppliers, and landlords. A schedule for the submission of the restructuring plan has not yet been announced.

With the restructuring proceedings, Hellweg Austria is pursuing the goal of meeting creditor claims while continuing business operations. In restructuring proceedings, creditors generally receive a dividend on their claims, while the company is restructured under the protection of the proceedings. Self-administration gives management more room for maneuver than a classic insolvency proceeding.

For employees at the six locations, the opening of the proceedings initially means uncertainty, but also the prospect that the company is to be continued. Dismissals are not automatically provided for in restructuring proceedings, but can be part of the restructuring plan if it includes cost-cutting measures. The company has so far not commented on whether and to what extent jobs will be cut.

Outlook on the further proceedings

The hardware and garden center sector has been under pressure for months. Rising energy and material costs, weaker demand in the DIY sector, and the general trend toward online orders have shrunk the earnings of many retailers. With its restructuring filing, Hellweg Austria joins a growing list of retail companies that have reported economic difficulties in recent months.

The impact on suppliers is not yet foreseeable according to the company. Hellweg Austria, however, pointed out that it would communicate „frühzeitig und transparent" with all partners. Suppliers who have outstanding claims must expect pro-rata settlement within the framework of the restructuring proceedings.

The coming weeks will show whether self-administration brings the desired success. The Linz Regional Court must first appoint a restructuring administrator and publish the opening order.
