Jens Spahn resigned on 18 July 2026 from his office as chairman of the Union parliamentary group in a letter to the CDU/CSU Bundestag faction, after the debate surrounding the birth of his child through a surrogate in the USA had led to massive calls for his resignation from within his own ranks.

In the letter, which was made available to the Deutsche Presse-Agentur, Reuters and other media, Spahn stated: „Ich habe die Parteivorsitzenden von CDU und CSU, Friedrich Merz und Markus Söder, darüber informiert, dass ich mit diesem Schreiben an unsere Fraktion von meinem Amt als Vorsitzender der CDU/CSU-Bundestagsfraktion zurücktrete.“ The „Bild“ newspaper had previously reported on the decision. Spahn thanked the faction members: „Ich danke Euch allen für die gemeinsame Arbeit in den letzten 14 Monaten und wünsche Euch alles Gute.“
