The 42-year-old suspect has filed a legal challenge against murder charges in the 2005 killing of Daniela Kammerer, a student stabbed to death in Innsbruck, citing "formal reasons" for his objection.
Defense Challenges Legal Basis
Attorney Mathias Kapferer confirmed the objection to the "Tiroler Tageszeitung," stating his client wants "formale Gründe" (formal grounds) examined. The defense argues that the prosecution’s reliance on a cigarette with the suspect’s DNA—found at the crime scene but not fully analyzed in 2013—violates legal principles.
Kapferer emphasized that criminal law follows the principle "Ne bis in idem" ("not twice in the same matter"), which restricts reopening cases without new substantive evidence. "Das Strafrecht folge dem Grundsatz 'Ne bis in idem' ... und ziehe diesbezüglich eine enge Grenze," he said, questioning whether the DNA evidence meets this standard.
