Verdict Expected in Espionage Trial of Former Austrian Intelligence Officer Egisto Ott

Ott is further accused of conducting a "failure analysis" for Russian intelligence following the 2019 Tiergarten murder in Berlin, where a Russian agent shot a Chechen exile living in Germany. The prosecution's 172-page indictment contains approximately 120 separate allegations against the former BVT officer.

The jury must answer 21 main questions to determine guilt in what has been described as Austria's most significant espionage case in recent decades. "The evidence against both defendants is overwhelming," the prosecutor stated, adding: "I haven't found a single witness who exonerates Egisto Ott."

The Charges

Ott's defense has argued that much of the case relies on speculation rather than concrete evidence. Defense attorney Anna Mair pointed to gaps in the prosecution's case, describing some mobile phone analyses as "alleged" and questioning whether intercepted messages tell the full story.

A key defense argument centers on the claim that Ott's contacts with Russia were part of a secret "Operation Doctor" sanctioned by his superiors. However, no witness confirmed this operation's existence, with one former deputy director dismissing it as "fake news" under oath.

In one of the more unusual charges, Ott is accused of saving €3.30 in fees by falsely presenting himself as an active police officer at a registration office in 2021, despite having been suspended. Prosecutors acknowledged this charge might end as a "bureaucratic farce" given Ott had the relevant receipt with him all along.

Ott addressed the jury directly at the trial's conclusion, stating: "I hope for a fair decision. If you have doubts (about the charges), I ask you to think clearly." His defense emphasized the principle that defendants should be acquitted in cases of reasonable doubt.

The case has highlighted vulnerabilities in Austria's intelligence apparatus and raised questions about foreign influence operations. Prosecutors described Ott's alleged actions as "years of corruption and treason against the republic with remarkable vehemence."

The verdict comes after years of investigation dating back to 2017. A conviction could have significant financial consequences for the 63-year-old former officer from Carinthia.
