Former Austrian Intelligence Officer Sentenced to Prison for Spying for Russia

The prosecution presented evidence that Ott had handed over service mobile phones belonging to high-ranking Austrian Interior Ministry officials to intermediaries linked to Jan Marsalek, a fugitive former Wirecard executive suspected of working with Russian intelligence. These devices were allegedly transported to Moscow via Turkey for further analysis.

In one particularly serious allegation, Ott was accused of creating an 'error analysis' following the 2019 Tiergarten murder in Berlin, where a Russian agent assassinated a Chechen exile. Prosecutors claimed this document contained non-public information and served as a 'guide for future contract killings' by Russian intelligence in the EU.

The Espionage Network

Ott maintained his innocence throughout the trial, claiming he was conducting a secret operation called 'Operation Doctor' for a Western intelligence service. However, no witnesses corroborated this claim, and his former superior dismissed it as 'fake news' under oath.

The case against Ott began in 2017 when Austrian authorities received warnings from a friendly intelligence service about possible information leaks. This led to investigations that uncovered his extensive contacts with Russian intelligence operatives.

Despite being suspended from duty since 2017, Ott continued to receive his monthly salary of 2,700 euros due to Austria's strict civil service laws. Prosecutors argued he maintained his lifestyle through substantial cash payments from unknown sources.

Operation Doctor Claim Dismissed

The verdict sends a strong message about Austria's stance on espionage. State Secretary Jörg Leichtfried called it 'very, very important for general preventive reasons,' emphasizing that 'spying is betrayal of our republic, our democracy, and our rule of law.'

Security experts noted the case highlights vulnerabilities in Austria's intelligence services. Thomas Riegler, a security expert, told reporters that while reforms have improved standards, 'of course this only impresses major powers to a limited extent.'

The Austrian government is now working on tightening espionage laws, with Leichtfried hoping for changes 'before summer.' These would make it easier to prosecute cases of treason and impose harsher penalties.

Political Fallout and Reforms

Ott's defense has filed an appeal and requested a new trial. His lawyer Anna Mair argued the case contained too many gaps where 'we have no evidence, only assumptions.'

The second defendant in the case, former BVT officer Anton H., received a 15-month suspended sentence for abuse of office. Meanwhile, another alleged accomplice, Martin Weiss, fled to Dubai to avoid prosecution.

The case has drawn international attention as part of broader concerns about Russian intelligence activities in Europe. It comes amid Austria's efforts to strengthen its counterintelligence capabilities following several high-profile espionage cases.

International Context

Wirecard, where Marsalek served as executive before its collapse in Germany's largest corporate fraud scandal, appears to have served as a cover for intelligence operations. Investigators believe Marsalek played a central role in connecting Ott to Russian handlers.

The 172-page indictment detailed approximately 120 separate allegations against Ott, painting a picture of systematic information gathering for Russian intelligence over several years. Prosecutors called the evidence against him 'overwhelming.'

In sentencing Ott to 49 months' unconditional imprisonment, the court deducted four months due to the excessive length of proceedings. The maximum penalty for his offenses would have been five years.

The verdict specifically noted that electronically monitored house arrest for 20 months was not an option, meaning Ott will serve his time in prison if the sentence stands after appeals.
