Austria's Administrative Court (Verwaltungsgerichtshof, VwGH) has declared the sale of alcohol in unstaffed vending machine shops impermissible, thereby ending a years-long legal debate surrounding the business model.

Reasoning of the Supreme Court

In its decision, the Administrative Court determined that rooms equipped exclusively with self-service vending machines and employing no staff do not constitute business premises within the meaning of the Trade Act. The sale of alcoholic beverages through such machines is therefore impermissible, according to the reasoning of the highest court.

The Trade Act provides for a prohibition on the sale of alcohol without physical ID verification. This is precisely the requirement that the vending machine shops fail to meet, since a personal check of the ID by employees does not take place. Nevertheless, it had previously been possible to purchase alcohol in such shops, which the court has now clearly forbidden.
