The Federal Government has made it clear that recruitment for military service in Russia alone is not grounds for asylum protection. This follows a ruling by the Berlin-Brandenburg Higher Administrative Court denying subsidiary protection to a Russian plaintiff.
The Federal Government reaffirmed on Thursday that conscription for military service in Russia does not in itself establish a right to protection in Germany.
A spokesperson for the Federal Ministry of the Interior stated in Berlin that recruitment alone is "not a phenomenon that triggers protection." "Every state has the right to recruit personnel for national defense," the spokesperson added.
The Federal Government's Position
The statement came in the wake of a ruling by the Berlin-Brandenburg Higher Administrative Court (OVG). The court dismissed a Russian citizen's lawsuit for subsidiary protection, thereby overturning a previous decision by the Berlin Administrative Court.
