The Scientific Service of the German Bundestag has determined in a legal opinion that the Ministry of Defense under Boris Pistorius (SPD) exceeded its executive powers by completely suspending the reporting obligation for conscription-eligible men.
The opinion, exclusively available to the ARD capital city studio, was commissioned by the Left Party faction in the Bundestag. It assesses the ministry's so-called general decree, which effectively nullified the reporting obligation for men between the ages of 18 and 45 at the beginning of the year.
The reporting obligation had been reactivated with the entry into force of the new Conscription Act on January 1, 2026. According to this act, male individuals aged 17 and above require permission from the responsible Bundeswehr career center if they wish to leave Germany for longer than three months.
