After life-threatening fall from regional train: Court rejects arrest warrant against 36-year-old

Over the weekend, the 26-year-old remained in a critical condition, according to sources close to the public prosecutor's office. No further details were initially released regarding the exact nature of his injuries or his further prognosis. The public prosecutor's office is investigating on suspicion of an attempted homicide offense.

Court rejects arrest warrant

Following the attack, the 36-year-old suspect was initially taken into custody. The public prosecutor's office then applied to the responsible Karlsruhe Local Court for the issuance of an arrest warrant. However, the court rejected this application, meaning the man was released over the weekend.

As the Karlsruhe Local Court announced, one of the reasons for rejecting the arrest warrant was that a judge did not consider the requirements for urgent suspicion of an offense and for a ground for detention to have been met. Details of the reasoning were not initially made public. As a result, the alleged attacker initially remained in pretrial detention.

Protests outside the local court

The decision triggered significant criticism and, according to a report by the "Badische Neuesten Nachrichten," sparked a demonstration outside the court on Sunday. Around 200 people reportedly marched to the local court to protest against the rejection of pretrial detention.

The Eisenbahn- und Verkehrsgewerkschaft (EVG) also responded with sharp criticism. EVG deputy chairwoman Cosima Ingenschay said the Chancellor must no longer remain silent: "Der Kanzler darf nicht mehr schweigen, er muss den Kampf gegen die Gewaltexzesse zur Chefsache machen". She accused the federal government of inaction on the announced tightening of criminal law.

Criticism from the EVG union

Ingenschay also criticized the fact that the tougher penalties announced in the wake of this case for attacks on rail employees continue to gather dust untouched in the Ministry of Justice. The union has long been calling for higher penalties and better protection for staff in local and long-distance public transport.

The Baden-Württemberg EVG chief Manuel Amberger also expressed dismay. In his view, the case has a "new, life-threatening dimension," Amberger said. Given the speed at which the employee fell from the train, the act was only not fatal due to fortunate circumstances.

Deutsche Bahn also condemned the attack. "Wir verurteilen den Angriff aufs Schärfste," the company said in a statement. It said it was in close contact with the investigative authorities and the Karlsruhe public prosecutor's office. The injured employee and his family are also being supported by the company.

Number of attacks on rail employees rising

The incident is part of a growing number of attacks on Deutsche Bahn employees. According to the federal government, the federal police recorded around 2,690 attacks on Deutsche Bahn employees last year. The number of such incidents has therefore risen continuously in recent years.

Union members see this as a worrying trend. The offenses range from insults and threats to physical attacks resulting in serious injuries. The EVG is therefore calling not only for tougher penalties but also for better staffing of security services on trains and in stations.

The federal government had already announced last year that it intended to tighten criminal law for attacks on public-sector employees. However, a concrete draft law has not yet been presented. Critics accuse the coalition of dragging its feet on the project.

Political reactions and open questions

The Karlsruhe public prosecutor's office announced that it would continue to investigate the case intensively. Among other things, it will examine whether and in what form the suspect had previously come to the attention of police. The role of the second security employee during the incident will also be part of the investigations.

In parallel, proceedings are underway against the 36-year-old on suspicion of attempted homicide. Should the initial suspicion be substantiated, the public prosecutor's office could apply for a new arrest warrant. Until then, the accused remains at large for the time being.

The case has now also taken on a political dimension. Interior and justice policymakers are under pressure to respond to the rising number of attacks on public-sector employees. Whether the announced tightening of criminal law will still be passed in this legislative period is currently considered uncertain.
