Following the attack on a Deutsche Bahn security employee who fell from a regional train traveling at 120 km/h near Karlsruhe, the Karlsruhe Local Court has rejected an arrest warrant against the 36-year-old suspected attacker, as the public prosecutor's office announced on Saturday.
Background of the Crime
The incident occurred on Friday evening on a regional train traveling at high speed toward Karlsruhe. According to the public prosecutor's office, the 36-year-old became involved in a violent altercation with the 26-year-old Deutsche Bahn security guard during a ticket inspection. The man was reportedly drunk and, according to the allegations, punched and kicked the security employee.
During the struggle, the 26-year-old fell and struck a train door again. When the security employee attempted to pull the passenger, who was lying on his back, back up, the passenger kicked forcefully at him. As a result of the subsequent fall from the moving regional train, the railway employee suffered the most severe injuries, according to the public prosecutor's office, and has been in life-threatening condition ever since.
Criminal Law Assessment
What exactly caused the fall from the train remains unclear, according to the investigators. The public prosecutor's office stated that the 36-year-old suspected attacker had prior convictions for violent offenses and is currently already serving a suspended prison sentence. Nevertheless, after his provisional arrest, he was released again, as the Karlsruhe Local Court rejected an arrest warrant.
Deutsche Bahn expressed its dismay over the violent act. A railway spokesperson said on Saturday: "Wir verurteilen den Angriff am gestrigen Abend in einer Regionalbahn aufs Schärfste." Manuel Amberger, state chairman of the Eisenbahn- und Verkehrsgewerkschaft (EVG), stated that their thoughts were with the injured man. The incident once again dramatically demonstrates "dass verbale und körperliche Übergriffe auf das Zugpersonal eine neue, lebensgefährliche Dimension erreicht haben".
Reactions from Deutsche Bahn and the Unions
The GDL union also reacted with sharp criticism. GDL chief Mario Reiß said on WDR following the attack: "Wir brauchen Entscheidungen der Justiz, wir brauchen Gesetzesänderungen und wir brauchen das Durchgriffsrecht." The union is thus demanding better protection for train personnel and more consistent criminal consequences for violent offenders in local public transport.
The case has reignited a debate about the safety of employees in public transport. Time and again, assaults on ticket inspectors and security personnel occur on trains and at stations.
