The Higher Regional Court of Vienna has acquitted Viennese lawyer Manfred Ainedter in an appeal proceeding and overturned the first-instance conviction for an alleged false testimony.
Ainedter, who had been sentenced last August at first instance by the Regional Court of Vienna to a partially conditional fine of 9,880 euros – 40 daily rates at 247 euros each – is now rehabilitated. The guilty verdict from the first proceedings was not upheld on appeal.
Confirmation of the acquittal came, according to an ORF report, from Ainedter himself, who spoke to the APA: He was "erleichtert und habe den Freispruch mit Genugtuung zur Kenntnis genommen", Ainedter said.
Reaction of the Accused
The costs of the appeal proceedings are borne, according to the report, by his adversary Manfred Hohenecker, who serves as a criminal judge at the Regional Court of Korneuburg. Hohenecker had become entangled in the case through former FPÖ politician Peter Westenthaler.
