The Berlin Regional Court has reduced the fine imposed by the Berlin data protection authority against the real estate company Deutsche Wohnen from an original 14.5 million euros to 900,000 euros.
At the center of the proceedings is the allegation that Deutsche Wohnen failed to sufficiently ensure the regular deletion of tenant data no longer needed between the end of May 2018 and the beginning of March 2019. The Berlin data protection authority had issued a fine notice of 14.5 million euros in October 2019 because it had identified violations of the General Data Protection Regulation (GDPR). Random checks had identified 15 individual cases.
Presiding Judge Simon Trost stated that the court did see a violation of the GDPR, but assessed it significantly more mildly than the authority. "We see a violation of the General Data Protection Regulation," said Trost. At the same time, he emphasized: "We see the violation in a milder light." The company had cooperated and worked on a technical solution, according to the reasoning.
