Criticism, however, is coming from the FPÖ. FPÖ Secretary-General and media spokesperson Christian Hafenecker spoke of a "hinterlistigen Frontalangriff auf die Meinungs- und Informationsfreiheit junger Menschen." He warned that a blanket ban would merely shift usage into areas that are harder to monitor and would restrict young people in their participation in public debates.

The issue is also controversial within the Austrian governing coalition. The SPÖ and the ÖVP have publicly positioned themselves over the past weeks, setting different priorities. Alexander Pröll and Andreas Babler are among the central voices in the debate and partly hold opposing positions on the planned project.

Criticism from the FPÖ

Regarding technical implementation, the digital identity "ID Austria" could play a role, according to the Media Ministry. It is intended to verify the age of users in the future, similar to approaches already being discussed in other European projects on age verification. Data protection advocates point in this context to the General Data Protection Regulation (GDPR) and open questions regarding proportionality.

The EU Commission has so far not published any conclusive statement. It is examining whether the planned national regulation falls within the scope of European directives such as the Digital Services Act and whether it is compatible with the internal market. An infringement proceeding has not been initiated at this stage but could become the instrument of choice if concerns persist.

Role of the EU Commission

Internationally, the initiative is being watched closely. Should Austria implement a corresponding regulation, it could have a model effect for other member states. Similar discussions are also underway in France, and stricter requirements for minors on social networks have been under consideration at the EU level for some time.

It remains unclear how a ban would be enforced in practice. Both a requirement for age verification by platforms and device-level blocks are being discussed. Critics doubt that such measures can be effectively implemented without simultaneously endangering data protection or freedom of expression.

Outlook on the Further Procedure

The Austrian government has announced that it intends to present the draft law still this year. Further statements from experts and a parliamentary deliberation are planned in the meantime. The European Commission could also specify its position in a formal procedure.

Observers see the project as a test case for how far member states can go in regulating social media. Should Brussels give the green light, or at least raise no objections, other EU states are likely to consider similar steps. Otherwise, a protracted legal dispute between Vienna and the Commission looms.
