The Chamber of Labour (AK) pointed out on Thursday that key provisions of the EU Pay Transparency Directive apply directly in Austria even without national implementation and can be enforced by employees in court.

Background: Deadline passed, no law

The deadline for transposing the EU Pay Transparency Directive into national law expired on 7 June 2026. Since Austria had not passed a corresponding law by that date, the Chamber of Labour is now drawing attention to the existing rights. AK President Renate Anderl stressed at a press conference: "Die Richtlinie ist ein EU-Gesetz und das gilt selbstverständlich auch bei uns."

The directive had been adopted by the Council of the European Union on 7 April 2023. It obliges companies, among other things, to inform applicants of the intended starting salary or a salary range. Employees are also entitled to know the criteria on which pay is determined, as well as to receive information on the average earnings of comparable employees, broken down by gender.
