In a decision published on Tuesday, the Constitutional Court (VfGH) sided with a journalist in a dispute over freedom of information against Hypo Vorarlberg Bank and criticized the interpretation of the Vorarlberg Regional Administrative Court.
What was the dispute with Hypo Vorarlberg about?
The case centered on the question of whether Hypo Vorarlberg Bank qualifies as a publicly listed company within the meaning of the Freedom of Information Act (IFG) and would therefore be exempt from the obligation to disclose information. The Vorarlberg Regional Administrative Court (LVwG) had answered this in the affirmative, reasoning that because the bank issues bonds, it should be regarded as a publicly listed company. The VfGH has now overturned this decision.
