Debate Over Data Glasses: Innsbruck Mayor Anzengruber Pushes Back Against Accusations

Criticism from Legal Scholarship

Legal expert Matthias Kettemann from the University of Innsbruck took a position in the Saturday edition of the „Tiroler Tageszeitung". He sees „weniger ein Rechtsproblem als ein Problem des unguten Umgangs mit digitalen Werkzeugen" and spoke of an „ungutes Signal". Kettemann pointed out that the respective conversation partners must be explicitly informed about the ongoing recording when the glasses are switched on. At the same time, he doubted that the small light signal on the frame would be sufficient: „gerade bei Gegenlicht und mit gewisser Entfernung nicht mehr erkennbar ist" – according to the expert.

Kettemann also warned that citizens could feel surveilled in conversation with the mayor, which he classified as „hochproblematisch". At the same time, he raised the fundamental question of „was genau diese Brille im politischen Kontext bringt". The expert's concerns are thus directed less at individual recordings than at the overall impression that may arise in contact with the city's leadership.

The Mayor's Arguments

Anzengruber countered the criticism with a fundamental argument: Anyone who generally problematizes wearing such a device „stellt letztlich die Frage, ob Politikerinnen und Politiker bestimmte technische Entwicklungen überhaupt nutzen dürfen", he said. He assured that he takes data protection seriously and pointed out that the glasses primarily serve to protect his eyes, i.e., a medical-pragmatic purpose.

In its response to the city council, the city leadership had previously explained that this is an AI-supported smart glasses that can create high-resolution videos and photos. This technical description differs from the mayor's portrayal, who emphasized everyday utility – phone calls, messages read aloud, eye protection. KPÖ and ALi see a discrepancy between technical capability and political practice.

Broader Context: AI Glasses in Public Spaces

The debate fits into a broader discussion about the use of AI-supported recording devices in public spaces. While proponents point to potential efficiency gains and accessibility, critics warn of a creeping normalization of surveillance technology. Anzengruber's case could become a precedent for other municipalities in Austria and beyond, shaping how such devices will be handled in political everyday life in the future.

The City of Innsbruck has so far not commented on whether adjustments to the glasses' use are planned. The data protection authority has also not yet publicly commented. Kettemann indicated that his main concern is less a legal assessment than a political self-understanding: „weniger ein Rechtsproblem als ein Problem des unguten Umgangs mit digitalen Werkzeugen" – this wording suggests that above all he wants to initiate a debate about standards.

Outlook: What Happens Next?

For his part, the mayor announced that he would stick to his previous usage behavior, provided no concrete legal requirements were imposed. It therefore remains to be seen whether the criticism from the city council and academia will lead to a review by the responsible data protection authorities or whether the debate will be conducted purely politically.

Overall, the conflict exemplifies how new technologies can change the relationship between officeholders and citizens. The Innsbruck debate could thus attract attention beyond the city limits, especially as AI glasses increasingly become available on the mass market and similar questions are likely to arise in many administrations sooner or later.
