Luxembourg, 3 November 2026

The European Court of Justice published an opinion in Luxembourg on 3 November 2026 stating that the existence of reproduction in the case of AI chatbots initially depends on whether an access barrier was circumvented.

Advocate General Maciej Szpunar explained in his opinion how the ECJ is likely to rule on the legal assessment of AI chatbots. The central issue is when the use of a system can constitute reproduction of protected works.

“But: Whether reproduction actually exists depends, according to Advocate General Maciej Szpunar, primarily on whether an access barrier was circumvented,” the opinion states. The document thus makes access to the relevant content the first step of the examination.
