A US jury in Oakland, California, dismissed Elon Musk's lawsuit against OpenAI on 18 May 2026, ruling that his claims were time-barred.

Elon Musk sued OpenAI and its CEO Sam Altman, alleging deception and seeking up to 134 billion USD in damages. He also demanded the removal of Altman and OpenAI's return to a non-profit structure.

The court found that Musk's claims were filed after the statute of limitations had expired. Under California law, such allegations become time-barred after three years.

OpenAI was founded in 2015 as a non-profit organization focused on AI research. Musk initially invested 38 million USD but left the board in 2018 and ceased all support by 2020.

Background

In 2019, OpenAI established a for-profit subsidiary, attracting significant investment from Microsoft. Musk accused OpenAI's leadership of turning the organization into a 'money machine' and 'stealing a charitable organization.'
