The General Court of the European Union in Luxembourg confirmed on Wednesday that Meta's Messenger service is subject to the stricter competition rules of the Digital Markets Act (DMA), as reported by Deutschlandfunk.

Background of the DMA

The competent chamber of the EU Court thus dismissed the lawsuit filed by the US digital giant Meta against the inclusion of Messenger in the list of so-called gatekeepers. The case number is T-1078/23. The decision confirms the classification of the service as a central access point between businesses and end-users.

The EU Commission had already classified Meta as an internet gatekeeper in 2023. The basis for this was the company's particular market power, which includes services such as Facebook alongside Messenger. Classification as a gatekeeper entails additional obligations under the DMA, aimed at ensuring fairer competition in the digital single market.
