An expert commission appointed by the Justice Ministry has, following the death of a severely mentally ill inmate at Hirtenberg Prison on December 3, 2025, presented a roughly 180-page report with 78 reform recommendations and warned that the Austrian prison system is reaching its limits.

The independent expert commission, led by Wolfgang Gratz, concludes that the inmate's death was "mit erheblicher Wahrscheinlichkeit" ("with considerable probability") avoidable had earlier recommendations from the internal audit and the Ombudsman Board been implemented sooner. The inmate had previously been transferred from Stein Prison, and according to the commission, important information regarding his medical history was not passed on. The situation escalated in a specially secured cell ahead of a planned transfer to a psychiatric clinic.

What Happened in Hirtenberg?

The inmate was restrained by prison guards and sustained serious injuries, dying in Eisenstadt Hospital. Twelve prison guards are being investigated on suspicion of bodily harm resulting in death through abuse of office. The commission's report identifies severe structural deficiencies, particularly in the handling of mentally ill inmates.
