The Federal Administrative Court in Leipzig definitively rejected the lawsuit filed by the environmental association BUND Hessen against the demolition permit for Block A of the decommissioned Biblis nuclear power plant on Thursday.
The Core of the Dispute
The judges thus upheld a ruling by the Hessian Administrative Court of Appeal from 2024, as stated in the decision announced on Thursday. The permit for the partial demolition of the facility, issued by the Hessian Ministry for the Environment in 2017, is therefore lawful. Block A of the power plant was permanently taken offline after the Fukushima nuclear disaster in 2011.
The central issue in the proceedings was how potential impacts of the demolition on humans and the environment should be assessed. BUND had criticized the environmental impact assessment as insufficient and feared that radioactive material could enter the environment. Specifically, the concern primarily related to slightly contaminated construction debris that might be disposed of in landfills after dismantling.
