The First Senate of the Federal Constitutional Court in Karlsruhe heard two lawsuits on July 7, 2026 against provisions in the Bavarian Police Tasks Act (PAG); a ruling is expected in a few months.
What is at issue in Karlsruhe
At the heart of the oral hearing is the question of whether the Bavarian Police Tasks Act violates fundamental rights in several respects. Specifically, it concerns the authority of the police to surveil individuals already in cases of an imminent danger, to secretly search computers and mobile phones, and to extend preventive police detention to a total of two months. David Werdermann, a lawyer at the Society for Civil Rights (Gesellschaft für Freiheitsrechte), sees this as a far-reaching expansion of police powers of intervention. He said: „Eine so umfassende Überwachung unter sehr schwammigen Voraussetzungen wie der drohenden Gefahr kann auch eine Einschüchterungswirkung haben."
