Federal Judge Dismisses Criminal Charges Against Salvadoran Migrant Kilmar Abrego Garcia

Abrego Garcia, a Maryland resident married to an American woman, was among more than 200 people sent to El Salvador's CECOT mega-prison in March 2025. Justice Department lawyers later admitted this deportation occurred due to an "administrative error," despite a 2019 court ruling that had protected Abrego Garcia from deportation due to dangers in his home country.

Background of the Case

After being brought back to the US, Abrego Garcia was immediately rearrested and charged with alleged human smuggling. These charges were dismissed by Judge Crenshaw, who stated: "The evidence before this Court sadly reflects an abuse of prosecuting power."

In a statement, the Department of Homeland Security called the decision "naked judicial activism" and maintained that Abrego Garcia's final order of removal stands, saying "this Salvadorian is not going to remain in our country."

Abrego Garcia, who was released from US custody in August, still faces potential deportation. In his own statement, he said: "Justice is a big word and an even bigger promise to fulfill; and I am grateful that today, justice has taken a step forward."

Legal and Political Implications

The case represents a setback for the Trump administration's immigration policies. Former President Trump had previously claimed without evidence that Abrego Garcia belonged to the Salvadoran gang MS-13 and was a 'terrorist.'

Judge Crenshaw's ruling highlighted concerns about prosecutorial conduct, noting: "Blanche's now unrebutted public statements tying the reopened investigation to Abrego's successful lawsuit taints the investigation with a vindictive motive." The judge specifically referenced Homeland Security Investigations (HSI), which conducts federal criminal probes, as the source of the problematic investigation.
