Germany’s justice system aims to classify date rape drugs as "dangerous tools" to impose stricter penalties for sexualized violence—but victims and experts doubt the effectiveness of the proposed measures.
Background
In 2024, the Federal Court of Justice ruled that date rape drugs do not qualify as "dangerous tools" under the criminal code. This decision is now set to be overturned through a legal amendment. Date rape drugs are substances often secretly mixed into drinks, rendering victims incapacitated.
Federal Justice Minister Stefanie Hubig (SPD) described the use of such substances as "sneaky and dangerous." She stated: "This is sexual violence in a particularly severe form—and it primarily affects women." Hubig emphasized the importance of victims seeking medical attention quickly if they suspect poisoning, to preserve evidence of the substances.
