Halle Administrative Court Halts Opening of Northern Part of Geiseltalsee for Water Sports and Tourism

The Geiseltalsee was fully opened to recreational and water tourism in May. With the now-issued interim order, this opening is being revoked for the northern part of the lake until a final decision is made on the NABU application.

Until a final decision is made on the application by the nature conservationists, only swimming is permitted in the northern part of the Geiseltalsee. Other activities such as sailing, surfing, or the offering of tourist uses are no longer permitted in this area for the time being.

NABU: Protection of Rare Breeding Bird Species on the Northern Shore

The NABU pointed out in a statement that rare bird species are currently breeding on the northern shore and need to be protected. The nature conservation organization had turned to the Administrative Court with the urgent application in order to prevent any impairment of the breeding areas by tourist operations.

Criticism came from CDU state parliament member and future Saalekreis district administrator Sven Czekalla. He emphasized that nature conservation and tourism had always been considered together in the past. He sees the tourist development of the Geiseltalsee at risk.

Political Criticism from Sven Czekalla

The decision of the Administrative Court concerns exclusively the northern part of the lake. For the remaining area of the Geiseltalsee, the opening for recreational and water tourism granted in May remains in place according to the current status.

With the interim order, the court is responding to the urgency of the nature conservation concern. As long as no final decision has been made on the urgent application, the previous opening in the northern part is considered suspended.

NABU Sachsen-Anhalt had argued in its application that the ongoing breeding season of the affected bird species on the northern shore required an immediate halt to tourist use. The court followed this reasoning with the temporary injunction.

Impact on Tourism and Water Sports

The now-applicable restriction to swimming means a temporary standstill of offerings for providers of water sports and tourist services in the northern part of the Geiseltalsee. The economic effects on the region are part of the political debate.

Sven Czekalla pointed out that the tourist development of the Geiseltalsee had been carried out over many years in close coordination with nature conservation interests. The current court decision calls this established practice into question.

From NABU's perspective, the protection of the breeding sites on the northern shore is not negotiable. The organization had already pointed out beforehand to conflicts between tourist use and the protection needs of the bird species.

The Halle Administrative Court will have to make a final decision on the NABU application in a main proceeding. Until then, the interim order applies as a provisional arrangement.

Outlook: Main Proceeding Still Pending

For visitors to the Geiseltalsee, the current situation means that only swimming is currently permitted in the northern part. Providers of boat tours, surf schools, or comparable offerings must pause their operations in this area.

The developments at the Geiseltalsee are being observed beyond Sachsen-Anhalt as well, since the lake is one of the largest artificially created bodies of water in central Germany and is of considerable importance for regional tourism.

With the decision of the Halle Administrative Court, the conflict between nature conservation and tourism at the Geiseltalsee is initially being decided in favor of species protection. The final balancing of both interests remains reserved for the main proceeding.
