The Munich Administrative Court has retroactively classified checks at German borders as unlawful in three cases, but the affected plaintiffs must continue to tolerate the measures until a final decision is reached.

The judges considered it proven that the checks at the German-Austrian border in the cases heard were not covered by a sufficient new threat situation. What is legally required for this is a new, serious threat – not merely "ongoing" high secondary migration. The internal border checks in place since September 16, 2015 had previously failed in court several times and were nevertheless extended three times, most recently until mid-September 2026.

Among those who filed suit were a commuter from Innsbruck who regularly crosses the border between Bavaria and Tyrol, as well as the Nigerian Abdulhamid A. A. was checked in July 2025 as the sole passenger in a train compartment and his papers were examined. In 2025, he was checked and his bag was searched. The Gesellschaft für Freiheitsrechte (GFF) is accompanying the proceedings.
