Background: The role of the Foundation Board

Specifically, the allegations concern claims that several members of the Foundation Board maintain activities in the PR industry or business relationships alongside their board duties that could conflict with their supervisory function at the ORF. Named among them is Gregor Schütze, against whom corresponding allegations have been raised. Independent confirmation of these allegations has not yet been forthcoming.

ORF Director General Ingrid Thurnher had already made the matter public and pointed to possible conflicts of interest. Roland Weißmann, a member of the Executive Board, also spoke critically about the current composition of the body. Both see the credibility of the broadcaster at risk should opaque connections remain.

Allegations against board members

Also coming into focus is Peter Westenthaler, a former Foundation Board member who had repeatedly attracted attention in the past through media-policy statements. Westenthaler rejects the allegations against his person. Clemens Pig, another board member, also spoke out in the debate and emphasized the need for transparent rules for secondary employment.

The responsible media authority KommAustria is also observing the developments. It is responsible for the regulation of broadcasting in Austria and can intervene in the event of violations of the ORF Act. Observers assume that the authority could at least initiate a review of the allegations.

For the planned constitutional complaint, the precise line of attack is decisive. The complainants argue that the funding cuts endanger the constitutionally guaranteed mandate of the ORF to provide the population with independent information. They refer to the BVG-Rundfunk, which governs the financing of the public broadcaster.

Arguments for the constitutional complaint

It is currently unclear what specific sums are under discussion and which program areas would be most affected. Possible staff reductions have also not been officially quantified in the debates so far. The ORF had emphasized in earlier statements that savings of the proposed magnitude could not be implemented without quality losses.

A transparency report, which could have clarified the allegations against the Foundation Board members, plays a special role. According to current information, however, this report is not to be published. Critics see this as a further indication that the clarification of the matter is being obstructed.

Open questions and outlook

The complaint at the Constitutional Court is likely to be heard only several months from now. Until then, the question remains open as to how the ORF can continue its reporting under the planned austerity measures. Public confidence in the independence of the broadcaster is also directly tied to the clarification of the allegations.

Political reactions to the announced complaint are muted. While opposition parties reject the cuts and welcome the complaint, government representatives point to the need for prudent budgeting. A swift resolution of the dispute over ORF financing is currently not in sight.
