Prince Harry Loses Lawsuit Against Publisher of the «Daily Mail»

The plaintiffs had accused the publisher of obtaining private information through wiretapping, the deployment of undercover investigators, and other questionable methods. This practice had intruded into the private lives of those affected and had been systematically exploited in the articles, their lawyers argued. The publisher rejected the allegations and insisted on the legality of its journalistic work.

In a joint statement with co-plaintiff Baroness Doreen Lawrence, Harry expressed disappointment over the outcome. They had gone to court «um Gerechtigkeit und Rechenschaft zu suchen. Doch wir haben weder das eine noch das andere erhalten», the statement says. The two speak of a «regelrechte Vertuschung» that comes «leider nicht gänzlich unerwartet».

Reactions From Harry and Lawrence

Harry and Lawrence particularly criticized the effort the court had undertaken to exonerate the «Mail». «Der Aufwand, den das Gericht jedoch betrieben hat, um die 'Mail' zu entlasten, ist ebenso schockierend wie völlig ungerechtfertigt», they write. If the court declares that there is no sufficient evidence of wrongdoing, «obwohl die Dokumente das Gegenteil belegen, dann fragt man sich, wie der Gerechtigkeit überhaupt Genüge getan werden sollte», the statement continues.

The co-plaintiffs include, among others, pop star Elton John and his partner David Furnish, as well as other celebrities. They, too, must now reckon with financial consequences. According to a report by the British «Guardian», the prince and the other plaintiffs could face litigation costs of up to 50 million pounds – roughly 58.5 million euros. The publisher Associated Newspapers put the total costs at over 53 million Swiss francs.

Possible Costs and Consequences

The ruling represents a stinging defeat for Harry, who has been taking parts of the British tabloid press to court for years. In 2023, he had already won a case against the publisher of the «Daily Mirror» over phone hacking. In the current case against Associated Newspapers, however, he was unable to achieve success, even though, according to his own account, he had submitted extensive evidence.

The defeat raises questions about the prince's future strategy in dealing with the British press. Observers see the ruling as a clear signal of how difficult it is to hold publishers liable in the United Kingdom for allegedly unauthorized research methods – even when prominent figures bring suit.

Outlook on Future Proceedings

In response to the ruling, Associated Newspapers rejected the allegations and welcomed the decision. It had always relied on lawful journalistic means, the publisher stated. The reaction from Buckingham Palace to the court decision and the prince's sharp criticism was reserved; a spokesperson referred to ongoing legal steps.

For Harry and his co-litigants, alongside the financial burden, there is also a call for reform of British press law. They had argued in the proceedings that the existing rules insufficiently protect those affected. Whether political consequences will follow remains open.
