QimiQ Restructuring: Creditors to Receive 20 Percent of Their Claims

Quota and Timeline

The submitted restructuring plan provides for a quota of 20 percent. This means that the recognized creditors are to be paid one-fifth of their original claims within a period of two years. Exactly how this quota will be financed is part of the ongoing proceedings.

According to KSV1870, creditors have so far filed claims totaling approximately 6.3 million euros. Of these, around 4.2 million euros have already been recognized, while the remainder remains disputed. Only once all claims have been conclusively reviewed can the restructuring proceedings formally continue.

The cream product QimiQ is a widely used component of the gastronomy and baking ingredients range in Austria and neighboring countries. The Salzburg-based company is one of the better-known brands in the field of cream-product preservation and supplies both the food retail trade and commercial customers.

Significance for the Trade

Through the ongoing proceedings, the company is attempting to stabilize its business operations and to settle its financial obligations toward its creditors in an orderly manner. An insolvency proceeding with the goal of restructuring is not necessarily synonymous with a final business closure, but can provide the framework for a reorganization.

Alongside the legal steps, it remains unclear how supply in the retail sector will develop further. Industry observers point out that product recalls and supply shortages could undermine the confidence of consumers as well as major buyers. The coming weeks will show whether the company can maintain its restructuring course.

The next round of negotiations at the Salzburg Regional Court is decisive in determining which further claims will be recognized and what the final quota will be. A conclusive distribution to the creditors can only be expected once the legally binding decisions are available.

In addition to the immediate creditor claims, labor law questions are also on the table, the effects of which on the company's employees are currently the subject of reporting. The progress of the proceedings is therefore being monitored on several levels.
