In the dispute between Café-Konditorei Fürst and Confiserie Josef Holzermayr over the "real" Salzburg Mozartkugel, the Salzburg Regional Court has prohibited Holzermayr from using the advertising claim "Original recipe from 1880" due to insufficient evidence.
The judges justified their decision by stating that the designation "according to the original recipe from 1880" necessarily requires that the original recipe from the year 1880 be known and presented, which had not been done. Holzermayr had failed to provide this proof, the court announced.
The plaintiff was Café-Konditorei Fürst, which sees itself as the inventor of the Mozartkugel. The court simultaneously determined that Fürst's own advertising referring to the inventor of the Mozartkugel was neither misleading nor unfair competition. Fürst thus prevailed on this point but lost on the broader claim.
