Dispute over the Salzburg Mozartkugel: Case heads to next hearing at the Salzburg Regional Court today

Currently, only the Konditorei Fürst is officially permitted to advertise as a manufacturer using the term "original." However, according to the trial reports, the current proceedings are not about the designation "Original," but rather about a decoration from the year 1905. According to the Konditorei Fürst, this award was presented to Paul Fürst for his Salzburg Mozartkugel at the 1905 Paris Exhibition.

Positions of the Two Parties

Clemens Thiele, attorney for Confiserie Holzermayr, views the exclusive use of the term by the opposing side critically. "Original ist sicher jeder Salzburger Mozartkugel-Erzeuger", said Thiele. He added: "Das hat aus meiner Sicht schon einen schweren Stand – mit 'original', auch mit 'echt' und wohl auch mit Salzburg".

Attorney Dieter Heine, who represents the Konditorei Fürst, emphasizes the pioneering role of his client. "Paul Fürst ist der Erfinder der Mozartkugel, Paul Fürst wurde schon 1905 dafür ausgezeichnet", said Heine. He also sharply criticized the competitors: "Holzermayr verkauft ein Industrieprodukt, das er zukauft."

Dispute over the 1905 Award

Confiserie Holzermayr sees a problem in the Konditorei Fürst's use of the historical award. Thiele explained on the matter: "Warum da so viel Exklusivität – auch unter falschen Voraussetzungen – in Anspruch genommen wird, ist mir nicht ganz klar". With this, the Confiserie is hardening its position against the long-established confectionery from the Salzburg old town.

Legally, the dispute revolves around the question of whether the 1905 Paris award can be attributed exclusively to the Fürst family or should be understood as an award for the Mozartkugel as a whole. The proceedings at the Salzburg Regional Court are scheduled to continue on Thursday, according to reports.

Both parties are showing themselves ready to fight in court. While Confiserie Holzermayr fundamentally questions the Konditorei Fürst's exclusive claim to the word "original," Fürst is standing firm on the historical merit of its founder Paul Fürst and the associated advertising rights.

Industry observers interpret the new hearing date as a clear signal that the trademark dispute over one of Austria's most well-known confectionery products is far from over. The court's decision is also likely to have a signaling effect for other manufacturers in the region who advertise using the Mozart name and the Salzburg connection.
