From draft to compromise
In the parliamentary process, the draft was weakened on key points. Lowering the age of criminal responsibility to 14, along with an explicit separation between criminal responsibility and the possibility of detaining children, ultimately secured a broader majority. Certain categories of offences were removed from the scope of application in order to preserve the principle of proportionality.
Another innovation concerns the definition of the concept of criminal responsibility itself. In the future, a clearer distinction is to be made between the question of from what point a person can be held accountable for an act, and the question under which conditions deprivation of liberty for young people is permissible at all. In doing so, Parliament is responding to criticism that the previous regulation had improperly conflated both aspects.
