The government of US President Donald Trump has turned to the Supreme Court of the United States in the dispute over a presidential order on mail-in voting for the 2026 midterm elections.

The Trump administration appealed to the Supreme Court after a federal judge had assessed the corresponding presidential directive as unconstitutional in court proceedings. In her reasoning, the judge wrote that the president's decree was "a likely unconstitutional regulation, compliance with which is practically impossible with regard to the 2026 midterm elections," according to the ruling, which was confirmed by eight sources.

The legal dispute centers on an order intended to reorganize the mail-in voting process for the 2026 congressional elections. The plaintiff side had argued that the directive violates applicable election law and could no longer be implemented by the responsible election authorities before the midterm elections. The judge agreed with this assessment and ruled in favor of the plaintiffs.
