Aargau commissions external investigation into abuse case – residence permit proceedings now before the Administrative Court

Background: Criticism of earlier official actions

The background to the case is a repeatedly raised allegation that authorities failed to act, or did not act quickly enough, despite earlier reports. This criticism was voiced, among others, by SVP member of the cantonal parliament Patrick Frei in the Grand Council, who tabled parliamentary motions to seek clarification. The Aargau political scene and regional reporting, for instance by SRF, also picked up the case and raised questions about the responsibility of municipal and cantonal bodies.

The canton had repeatedly stressed that ongoing proceedings could not be commented on publicly. With the now-announced external review, it is departing from this line and signalling its willingness to carry out a transparency-oriented examination. The municipality of Untersiggenthal had already come into focus earlier because, after the allegations became known, it had provided only limited information.

Residence permit and Administrative Court proceedings

The accused, who is being investigated for multiple sexual assaults on children, holds foreign nationality according to the canton and therefore depends on a residence permit. Whether and when this permit will be renewed or revoked depends, according to the canton, on the outcome of the Administrative Court proceedings. The external investigation expressly does not touch on this question, as it is intended to examine only past official decisions.

Reactions from the political sphere were cautious but fundamentally positive. SVP member of the cantonal parliament Patrick Frei welcomed the external review as an overdue step, while stressing that the clarification must continue to be accompanied at the parliamentary level. There were also demands from bourgeois circles in the Grand Council that the findings of the investigation be made publicly available. The canton has so far only assured an internal evaluation and, where appropriate, a statement, without committing to a full publication.

Political reactions in the Grand Council

At the centre of the review is the question of what information was available to the authorities at what point in time and what steps were taken or omitted as a result. The review is also to determine whether the cooperation between the municipality, the canton, and other involved bodies complied with legal requirements. This concerns both procedural workflows and the flow of information between the bodies involved.

The case has attracted attention in the region and beyond because it is seen as exemplary of how reports of sexual violence against minors are handled. Children's and youth protection organisations had previously called for cantonal procedures in suspected cases to be regulated more bindingly and for processes to be documented. The canton pointed to existing legal foundations and at the same time announced that it would review its own processes in light of the investigation's findings.

What the external investigation will examine

By commissioning the external investigation, the canton is taking on an unusual role in such cases: it is having its own actions assessed by an independent body while criminal proceedings against the accused run in parallel. This separation is intended to prevent the examination of possible official errors from being conflated with the outcome of the criminal process. Whether the investigation will result in consequences for individual employees or organisational changes remains open until the report is available.

Outlook: Results in spring 2027

The results of the external review are expected in spring 2027, according to the canton. Until then, the government does not wish to comment further publicly on the ongoing administrative and criminal proceedings. At the same time, it announced that it would inform the Grand Council of the key findings once the report is available. Whether this will also lead to a public report has not yet been decided.
