A U.S. federal appeals court has delivered a preliminary victory to the Pentagon in its legal dispute with the New York Times, once again permitting the escort rule for journalists at the Department of Defense.

The appeals court thereby overturned a previous order from a lower court that had barred enforcement of the rule during the ongoing proceedings. As set out in the court's reasoning, it found a high likelihood that the Pentagon will ultimately prevail on its arguments. A final decision in the case has not yet been issued.

Specifically, the rule requires that reporters move through the Pentagon building only when accompanied by a department employee. The Pentagon had defended the general escort requirement as lawful, arguing that it does not constitute an impermissible retaliatory measure within the meaning of the First Amendment, which protects, among other things, freedom of the press.
