Austria’s advance directives for assisted suicide will become valid indefinitely from 1 June 2026, after the Constitutional Court struck down the requirement to renew them annually.

Constitutional Court Ruling

The Sterbeverfügungsgesetz, which has been in force since January 2022, allows people who wish to die to end their lives through assisted suicide, provided they have established a legally valid advance directive. Until now, the law required that this directive be renewed after one year through a complex and costly procedure.

At the end of 2024, the Verfassungsgerichtshof (VfGH) ruled that the mandatory one-year renewal was unconstitutional. The court acted after several applications were filed in 2023 by the Österreichische Gesellschaft für ein humanes Lebensende (ÖGHL) and other individuals.
