Berlin: Civil Servants' Pay Reparation Act – Over One Billion Euros in Back Payments

According to the finance administration, the financial burden from the back payments is likely to amount to significantly more than one billion euros. This makes it one of the largest retroactive pay adjustments the State of Berlin has had to make in recent decades.

Billion-Euro Estimate by the Finance Administration

The parliamentary groups represented in the state parliament must now deliberate on the concrete design of the law. In addition to the question of the exact amount of back payments, this also concerns the timing of the payout as well as possible transitional arrangements for certain pay groups.

The procedure is being accompanied politically by the Police Union, which is demanding a swift and full back payment for its members. From the union's perspective, the correction of pay is long overdue, since the too-low remuneration had been tolerated for years.

Positions in the House of Representatives

The opposition in the House of Representatives criticizes the fact that the financial consequences of the law have not been sufficiently taken into account in previous budget planning. It demands binding statements from the government on how the back payments are to be financed without jeopardizing other state expenditures.

At the same time, the finance administration emphasizes that the billion-euro figure mentioned is an estimate based on assumptions about pay groups, lengths of service, and individual life circumstances. A final amount can only be quantified after the law has come into force and after the individual cases have been evaluated.

Support for the initiative comes from the ranks of the governing parliamentary groups. They point out that the Federal Constitutional Court has obligated the legislature to ensure constitutionally compliant pay and see the reparation act as the necessary response to this ruling.

What Remains Open

Until the law can be finally deliberated in the House of Representatives in the afternoon, numerous detailed questions remain open. These include regulations on the interest to be paid on back payments, the treatment of pension recipients, and the administrative procedures by which the individual claims are to be determined.

For those affected, the procedure means that – unlike with an ongoing salary increase – they will not automatically receive a higher payout. Rather, the responsible bodies must review the claims and determine the back payments individually, which, based on experience, is likely to take some time.

Observers assess the draft law as a political signal beyond Berlin. Should the Civil Servants' Pay Reparation Act enter into force, it would set a precedent for how a state concretely implements the Federal Constitutional Court's specifications on civil servant pay – and what financial burdens such a correction entails.
