The judges stated verbatim: „Es hatte den Mietendeckel der damaligen rot-rot-grünen Landesregierung in Berlin für ungültig erklärt, da die Gesetzgebungskompetenz nicht bei den Ländern, sondern beim Bund liege." This meant the Berlin initiative had failed.

According to the Left Party, Kingreen argues that a rent cap can very well be compatible with the Basic Law, provided it is enacted on a federal statutory basis. This distinguishes the Left's current demand from the 2021 model that failed, which had been adopted at the state level.

Scholarly Arguments

The Left faction's spokesperson on housing policy in the Bundestag, Caren Lay, is one of the most prominent voices to have been calling for a cap on housing costs for years. She holds the position that, given rising rents in major cities, state intervention is necessary.

From the Left Party's perspective, the situation on the Berlin housing market remains tense. The party points to high asking rents and increasing displacement in inner-city neighborhoods. The rent cap is intended to ensure that tenants can afford housing in the long term.

Situation Ahead of the Election

In campaign terms, the issue is given additional weight by a poll released about a month before the Berlin House of Representatives election. According to it, the Left, with its lead candidate Elif Eralp, reached 22% and was thus clearly ahead in that survey at the time. The party is counting on the housing issue to reinforce this trend.

Opponents of a rent cap, including CDU representatives such as Bundestag member Jan-Marco Luczak, consider state intervention in the housing market economically harmful and warn of negative consequences for investment in new construction. They instead favor expanding the housing supply through the private sector.

Opposition Position and Debate in Other Cities

The debate is also being conducted intensively outside Berlin, for example in Munich, where rents have also risen significantly in recent years. Comparable demands for state-imposed caps are being raised there as well, although no comparable state law has yet come into force.

What legal form a future rent cap could take remains open. Kingreen points to the need for a federal law that the states must not circumvent. The Left Party insists that federal politics must drop its resistance in order to secure affordable housing in major cities.

Until the Berlin election, the rent cap remains a central campaign pledge of the Left. Whether the announced constitutional argument will hold up in a possible legislative process is currently unclear.
