The Bundesnetzagentur is not permitted to commission an independent review of Deutsche Post's letter delivery times for the time being, after it lost a legal dispute at the Higher Regional Court of Düsseldorf in the final instance regarding a market research company that had been excluded.

Background: Failed tendering process

The Bundesnetzagentur is therefore unable to fulfill its statutory mandate to monitor Deutsche Post's letter delivery times for the time being. According to the authority, a new tendering process must instead be initiated. "Es muss ein europaweites Vergabeverfahren neu aufgesetzt und dann entsprechend den gesetzlichen Vorgaben durchgeführt werden," the authority stated.
