The Bundestag elected the Freiburg legal scholar Moritz Hennemann on 25 June 2026 with 391 votes as the new Federal Commissioner for Data Protection and Freedom of Information.

The 41-year-old was elected for five years in an open ballot. 391 members of the Bundestag voted for the candidate, 77 abstained. At least 316 votes were required for election. Hennemann had been proposed by the Federal Government on the proposal of the Union parliamentary group. The coalition partner SPD supported the nomination.

Hennemann, born in 1985, has been Professor of Information, Media and Internet Law at the University of Freiburg since October 2023. He took over the chair of Civil Law with Information Law, Media Law and Internet Law at the Albert Ludwig University of Freiburg. He is thus only six years above the statutory minimum age of 35 prescribed for Federal Data Protection Commissioners.
