Buwog Case: Ten Years of Proceedings End with Defeat for Grasser Defense

The Buwog case is considered one of the largest economic criminal cases in Austrian postwar history. At its center is the allegation that during the 2004 sale of the federally owned housing company Buwog, commissions in the millions flowed to intermediaries in which Grasser and co-defendants are alleged to have participated. The main trial was preceded by years of investigations that culminated in the process launched in 2017.

In the ongoing proceedings, alongside defense lawyers such as Dieter Böhmdorfer and Manfred Ainedter, the well-known criminal law scholar Friedrich Forsthuber also appeared, who in the past had publicly criticized the case as politically motivated. The Economic and Corruption Public Prosecutor's Office had already emphasized in earlier stages of the proceedings that the factual and evidentiary situation must be examined independently of personnel questions. The outcome is also a signal to those critics who had accused the investigators and the public prosecutor's office of excessive duration of proceedings. The now nearly ten-year duration of the proceedings since the start of the trial is also the subject of a pending complaint before the Constitutional Court. At the defense lawyers' office, the decision was initially acknowledged in brief words. They said they would inform the client about the further course of action. On the very day of the decision, observers noted that the Buwog case is likely to occupy the Austrian judiciary for years to come – whether through pending judgments, follow-up proceedings, or constitutional review.

The Buwog case thus remains a litmus test for the resilience of the domestic criminal justice system. With the defense's defeat in the bias dispute, the last hurdle has been cleared before the court enters the final phase of the taking of evidence.

For the judiciary, the decision means a stabilization of case management. Judge Hohenecker, who has led the trial since December 2017, can continue to preside over the courtroom. Observers see this as a vote of confidence in a judge who has repeatedly faced hostility in recent years.
