Constitutional Debate: SPD Does Not Want to Enshrine Heat Protection in the Basic Law

To justify its position, the SPD points to the existing architecture of the Basic Law. Article 104b already opens up the possibility for the federal government to grant financial assistance to the federal states and municipalities for «bedeutsame Investitionen», without the federal government interfering in implementation on the ground. This instrument offers a flexible framework that can be deployed in a targeted manner.

At the same time, the SPD emphasizes that these financial aids are not designed as permanent subsidies. Rather, they are conceived as targeted investment aids that can respond to special needs in the short term. In the party's view, an additional constitutional amendment would unnecessarily complicate this structure.

The discussion comes at a time when the federal government and the federal states are deliberating on adjustments in civil protection, urban planning, and healthcare in light of recurring heatwaves. Municipalities are demanding reliable funding to implement heat protection concepts in schools, care facilities, and public spaces, among other places.

Reactions from the Federal States and the Union

From the Union, by contrast, there are cautious signals. The Union side points to the federal states' responsibility for civil protection and emphasizes that additional constitutional norms would have to be carefully examined. An expansion of the Basic Law to include climate- or heat-related state objectives is currently not a shared concern.

Observers of political Berlin interpret the SPD's move as an attempt to bring the debate back to the substance. The party is showing itself open to concrete investment aid based on Article 104b, but rejects a symbolic loading of the constitution. In doing so, it is positioning itself between more far-reaching demands from the federal states and the rejecting stance of the Union.

The coming weeks will show whether the SPD will bring its proposal into the Bundestag or sound it out in informal talks with the federal states and municipalities. One thing is already clear: without a two-thirds majority in the Bundestag and the Bundesrat, a constitutional amendment would not be enforceable in any case.

Outlook on the Further Debate

Regardless of the constitutional question, health organizations point out that heat protection can already be implemented at the municipal level – for example, through cool rooms, drinking water offerings, and adjusted working hours. The SPD signals that it would support such measures via existing financial aids.

Throughout the entire debate, it also remains open what role other constitutional norms could play. Article 20a of the Basic Law already obligates the state to protect the natural foundations of life; a direct reference to heat protection is, however, assessed inconsistently by constitutional scholars.
